1. Scope

These Terms and Conditions (“T&C”) apply to the use of the Rabattcorner.ch platforms operated by Rabattcorner AG, Lessingstrasse 11, 8002 Zurich (“Rabattcorner”), in particular the website rabattcorner.ch, the Rabattcorner app, and the Rabattcorner browser add-on (collectively, the “Rabattcorner Platforms”).

2. Participation in the Rabattcorner program

2.1 The Rabattcorner program is open to individuals who have registered for it on the website rabattcorner.ch (“Participants”). Any natural person with at least limited legal capacity, as well as associations of individuals and legal entities, is eligible to register. Registration can only be completed online.

2.2 Once the participant has registered, a personalized user account is created on Rabattcorner. The user account is provided free of charge to all participants. The contract between the participant and Rabattcorner is concluded upon registration and the creation of a user account.

2.3 Upon registration, the participant is required to provide accurate information. Any changes to the information provided must be reported to Rabattcorner immediately. If the participant fails to comply with this obligation, they shall bear all resulting consequences themselves.

2.4 Rabattcorner may refuse a participant’s registration without providing a reason.

3. Cashback Guarantee

3.1 By participating in the Rabattcorner program, participants are eligible to receive cashback on purchases made from Rabattcorner’s partner companies. Once the conditions set by Rabattcorner have been met, the specified cashback will be credited to the participant’s Rabattcorner user account.

3.2 Cashback can be earned by entering into transactions (purchasing goods, using services, etc.) with Rabattcorner partners as part of this program. After completing a transaction eligible for cashback, the corresponding cashback amount will be provisionally credited to the participant’s user account or recorded as a provisional credit. The final credit will be issued once the conditions specified by Rabattcorner have been met. The cashback credit may be canceled if the participant violates the terms and conditions or if the requirements for receiving the cashback are not met. Cancellation is possible even after the final credit has been issued.

3.3 The cashback amount that Rabattcorner passes on to the participant is determined by Rabattcorner. Certain goods and/or services may be excluded from the cashback offer. The information presented to the participant is for reference only and is not binding on Rabattcorner.

3.4 Credits will only be paid out to the participant if the following steps are followed when purchasing goods and/or using services from a Rabattcorner partner company:

• The participant has successfully registered on a Rabattcorner platform.
• The participant logged in to a Rabattcorner platform using their username and password.
• The participant clicked on the link to the partner company via a Rabattcorner platform (website, app, or browser add-on) and was automatically redirected to the partner company’s website via Rabattcorner’s technical redirection system, allowing the purchase to be technically attributed to Rabattcorner.
• The user performed a search on the Rabattcorner website, clicked on a partner company that appeared in the search results or in the categories, and was thus directed directly to the partner company’s website.
• The participant subsequently entered into a contract with the partner company for goods and/or services.
• The partner company has confirmed to Rabattcorner that the transaction has been completed and that the contractual obligations between the partner company and the participant have been fulfilled.
• The commission agreed upon between Rabattcorner and its partner companies has been credited in full to Rabattcorner’s account, irrevocably and unconditionally.

3.5 One of the services provided by Rabattcorner is the sending of promotional information about Rabattcorner, in particular offers from Rabattcorner’s partner companies, via newsletter. The participant may disable this service in their user account.

3a. Rabattcorner browser add-on

3a.1 Rabattcorner offers an optional browser add-on for Chrome, Firefox, Edge, and Safari. Installation and use are voluntary and free of charge.

3a.2 The add-on is designed (i) to notify users of available cashback from partner companies and (ii) to automatically compare product prices at selected Swiss online stores with the terms offered by Rabattcorner partner stores.

3a.3 The functionality of the add-on, particularly the data processing involved in price comparisons, is described in the Privacy Policy.

3a.4 The information displayed in the price comparison is sourced from external sources and is collected automatically. Rabattcorner does not guarantee the accuracy, completeness, or timeliness of the comparison results. The actual price listed in the respective online store at the time the contract is concluded is always decisive.

3a.5 The add-on can be uninstalled at any time via the browser’s add-on manager. Uninstalling the add-on will disable all of its functions and stop data processing by the add-on.

4. Payment of credits

4.1 As soon as the total of all credits definitively posted to the user account or marked as “confirmed” exceeds CHF 20, the participant may request a payout of the amount to their bank account or PayPal account. In doing so, the participant must confirm that they are the account holder of the relevant account and that the payout is therefore being made to them. Any fees and costs charged by the recipient bank or PayPal shall be borne by the participant.

4.2 Withdrawals to foreign bank accounts are not permitted. Additionally, withdrawals via PayPal are limited to amounts of up to CHF 200. If the withdrawal amount exceeds CHF 200, the funds must be transferred to the participant’s bank account at a Swiss bank.

4.3 Credit balances posted to the user account do not earn interest.

4.4 Rabattcorner is also released from its obligation to pay out credits under Section 4.1 if the bank or PayPal account most recently provided by the participant is associated with another person or does not exist.

4.5 If the participant does not make any purchases from Rabattcorner partners via the Rabattcorner platforms for more than two years, the credits will expire without compensation.

5. Access to your Rabattcorner account

5.1 Once a participant has successfully registered online on the Rabattcorner website, they can access their user account by authenticating themselves to Rabattcorner using their username and password or another method specified by Rabattcorner.

5.2 The participant is required to keep their password and username secure and protect them from unauthorized access by third parties. In particular, passwords must not be recorded. The participant may change their password at any time. All authorized and unauthorized transactions carried out using the participant’s password are deemed to be those of the registered participant. The participant therefore bears all risks and consequences arising from the use—including misuse—of their means of identification.

5.3 If the participant suspects that a third party has or may have access to their personal Rabattcorner login credentials, they must notify Rabattcorner immediately. Rabattcorner shall not be liable for any damages incurred by the participant as a result of the unauthorized use of their login credentials by a third party.

6. Liability

6.1 Claims for damages against Rabattcorner are excluded regardless of their legal basis, unless Rabattcorner acted with intent or gross negligence.

6.2 Rabattcorner shall not be liable for any damages incurred by the participant as a result of the participant’s failure to fulfill its contractual obligations to third parties, nor for any indirect or consequential damages, such as lost profits or consequential damages.

6.3 Rabattcorner is not liable for damages caused by Rabattcorner partners. Any contractual or non-contractual claims arising from or in connection with services provided by Rabattcorner partners may only be asserted against those partners.

6.4 Rabattcorner does not guarantee the availability or functionality of its systems at all times, nor does it guarantee the uninterrupted operation of the search function, access to the user account, the application of discounts, or any other services offered by Rabattcorner. Any liability for damages incurred by the participant as a result of transmission errors, technical defects, overload, interruptions (in particular due to maintenance work), malfunctions, or other deficiencies is excluded.

6.5 Rabattcorner makes no warranty as to the accuracy or completeness of the data made available to the participant. In particular, information regarding credits is non-binding, and Rabattcorner assumes no responsibility or liability for the content of websites on Rabattcorner’s platforms to which direct or indirect references are made (links to partner companies or advertisers). This applies in particular to the price comparison results displayed via the Rabattcorner browser add-on; these are non-binding references.

7. Termination, Withdrawal from the RC Program

7.1 Rabattcorner and the Participant may terminate the contractual relationship at any time, either immediately or effective at a later date.

7.2 Notice of termination must be given in writing or by email.

7.3 Rabattcorner reserves the right to terminate the Rabattcorner program at any time without providing a reason or to replace it with another program.

8. Changes to the Terms and Conditions

8.1 Rabattcorner may amend these Terms and Conditions at any time. The participant will be informed in advance via publication on the website, notification by email, or by other appropriate means. Changes are deemed approved unless a written objection is submitted within one month of notification, and in any case upon the participant’s next use of the Rabattcorner platform. Rejection of the changes by means of a written objection shall be deemed termination by the participant.

9. Data Protection

9.1 The Privacy Policy is an integral part of these Terms and Conditions. By accepting these Terms and Conditions, users also agree to the Privacy Policy.

10. Marketing purposes

10.1 The participant agrees that Rabattcorner may use participant data for internal marketing purposes.

11. Jurisdiction, Applicability of Swiss Law

11.1 All legal relationships between the Participant and Rabattcorner are governed by Swiss substantive law. The exclusive venue for all proceedings is Zurich. However, Rabattcorner is entitled to bring legal action against the Participant in any other competent court.
